Landlords can evict their tenants from April 23rd as 5km travel rule has been lifted

The lifting of 5km rule on non essential travel had given the landlords the right to evict their tenants from April 23rd onwards. The rule which introduced temporary protections for tenants have been taken apart. The Residential Tenancies Act 2020 protected the tenants from eviction which was sought to control the spread of the deadly virus.

The act expires as the level 5 restrictions were taken off. As the emergency period in the state have ended, the effective ban on most evictions have also ended.

The notice periods were paused according to the act and the termination dates needs to be recalculated. The main point is that if a person has 15 days left in his notice period before the law was enforced, he will have the same 15 day gap after the act was repealed. A 10 day grace period is also granted after the notice period ends.

In order to enjoy the additional protection, the tenants should not have rent arrears for not more than five months. The main essence of this system is that the landlord should not suffer anu financial hardship even after providing allowances to their tenants.
