The Dublin Criminal Court found out that the death of the worker Andezej Buraczewski, happened due to the defect in the scaffold in which the worker was standing. The construction company and its owner was fined by the court after they admitted the fault from their part. The company should pay a fine of €40,000 and the owner should pay a fine of €5000.
The Health and Safety Authority had told the Court that they already rated the scaffold as unfit and warned that nobody should stand on it. The construction company had violated the order and had to pay for the life of a human being. The company, Colin Wendel Development Ltd. was found guilty on failing to ensure the safety of its workers and left a person to fall, suffer an injury and die.
Mr. Wendel had apologized to Ms. Buraczewski on the mishap and he was asked to pay €20,000 as a compensation to the family of the deceased. The court had extended its condolences and said that what happened was purely an accident and the weakness of the scaffold didn’t affect everyone who used it in a same way.
